Last Will and Testament of David Van Tyle Qua

I David Van Tyle Qua of the town of Salem in the County of Washington and State of New York being of sound mind and memory, do make, ordain, publish and declare this to be my last Will and Testament that is to say:

First:

After all my lawful debts are paid and discharged, I give, devise and bequeath to my wife Rhoby Esther Qua all real or personal property, bank stock, money goods chattels of what nature or kind soever I may own at the time of my death.

Likewise I make, constitute and appoint my wife Rhoby Esther Qua my sole Executrix of this my last Will and Testament, hereby revoking all former Wills by me made.

In witness Whereof, I have hereunto subscribed my name and affixed my seal, the 30th day of November in the year of our Lord one thousand eight hundred and eighty five.

The above instrument consisting of one sheet, was at the date thereof subscribed by David V. T. Qua in the presence of us and each of us, he at the time of making such subscription acknowledged that he made the same, and declared the said instrument so subscribed by him to be his last Will and Testament. Whereupon we then and there, at his request, and in his presence and in the presence of each other, subscribed our names as witnesses thereto.

In the Matters of Proving
The Last Will and Testament
Of David V. T. Qua, deceased.
Washington County, S.S.

Marion E. Collins and Clara A. Hedges being duly sworn in Open Court, severally depose and say that they were acquainted with the above named David V. T. Qua in his life time, and that they and each of them were present, and saw him subscribe his name at the end of the instrument in writing now produced and exhibited to them, purporting to the Last Will and Testament of the said deceased, bearing date 30th day of November A.D. one thousand eight hundred and eighty five.

That the said deceased at the time of subscribing his name aforesaid, published and declared the said instrument to be his last Will and Testament in the presence of these deponents and each of them, and these deponents at the request of the said deceased, and in his presence, and in the presence of each other subscribed their names respectively thereto as witnesses to the execution thereof.

That the said Marion E. Collins has married since Nov. 30th, 1885, that her name on that day was Marion E. Congdon.

That the said Clara A. Hedges has married since Nov. 30th 1885 that her name on that day was Clara A. Gleason.

That at the time of the execution thereof, the said deceased was a citizen of the United States, above the age of twenty one years, of sound disposing mind and memory, and not under restraint to the best of the knowledge, information and behalf of these deponents.

Qua late of the town of Salem, in the said County, deceased, and also of the testimony taken by me on the probate thereof as a will of real and personal estate, which said Last Will and Testament was admitted to probate and recorded this 23d day of September, 1898.
