The Last Will and Testament of HENRY L. HEATH of
In the name of God Amen: I, HENRY L. HEATH of the town of
First. I order and direct my executor hereinafter named to pay all my just and
lawful debts and funeral charges as soon as may be convenient after my decease.
Second. I give devise and bequeath to my beloved wife MATTIE C. HEATH all my property
of every name and nature both real and personal to be hers absolutely and
forever and this devise and bequest is to be accepted by her in lieu of all
dower she may have in my real estate.
Third. I hereby nominate and appoint my friend EDMUND
H. GIBSON the sole Testamentary guardian of my two children JOHN M. HEATH and
WILLIAM <
Fourth. I hereby authorize and empower my executor
hereinafter named to sell and convey any or all of my real estate and give a
conveyance of the same whenever in his discretion it may be thought best to do
so.
Fifth. I hereby nominate and appoint my friend EDMUND
H. GIBSON, the sole executor of this my last will and testament hereby revoking
all former wills by me made.
In witness whereof I have hereunto set my hand and seal this sixteenth day of
February, one thousand eight hundred and eighty-six.

The above instrument was signed, sealed, published and declared by the above
named HENRY L. HEATH at the date thereof to be his last will and testament in
our presence and we at his request and in his presence and in the presence of
each other have signed our names as attesting witnesses.

In the matter of proving the last will and testament of HENRY L. HEATH,
Deceased.
WILLIAM HAYNES and JULIA H. MASON each of Greenwich in said county each being
duly sworn in open court < S aly > depose and
say that they were acquainted with the above named HENRY L. HEATH in his
lifetime: and that they and each of them were present and saw him subscribe his
name at the end of the instrument in writing now produced and exhibited to them
purporting to be the last will and testament of the said deceased bearing date
the 16th day of February A.D. one thousand eight hundred and eighty-six. That
the said deceased at the time of subscribing his name as aforesaid published
and declared the said instrument to be his last will and testament in the
presence of these deponents and of each of them and these deponents at the
request of the said deceased and in his presence and in the presence of each
other have subscribed our names respectively thereto as witnesses to the
execution thereof.
That at the time of the execution thereof the said deceased was a citizen of
the United States above the age of twenty one years of sound disposing mind and
memory and not under restraint to the best of the knowledge information and
belief of these deponents.
