Silas Hills

In the Name of God, Amen.

I, Silas Hills, of the Town of Kingsbury, Washington County and State of New York, being of sound mind and memory, and considering the uncertainty of this life, do therefore make, ordain, publish and declare this to be my last Will and Testament:

That is to say, First, after all my lawful debts are paid and discharged, I give and bequeath and devise unto my wife, Desire Hills, all my property, both real and personal, for and during her natural life. The income derived there from to be used for her support and maintenance.

After the death of my said wife, I give, devise and bequeath all of my said property, both real and personal, to my five children, viz.: Mary Hills, Isabelle Preston, Charles Hills, John D. Hills and Lottie Safford, share and share alike, except that said John D. Hills is to have twice as much as either of the others.

There shall be used out of my property at my wife's death enough to bury her decently, if she shall not leave enough property of her own for that purpose. Likewise I make, constitute and appoint my said wife, Desire Hills, to be Executrix of this my last Will and Testament, hereby revoking all former wills by me made.

In Witness Whereof, I have here unto subscribed my name, and affixed my seal the seventeenth day of January in the year of our Lord one thousand eight hundred and eighty four. Silas Hills

The above instrument, consisting of one sheet, was at the date thereof subscribed by Silas Hills, the Testator named in the foregoing Will, in the presence of us and each of us, and at the time of making such subscription the above instrument was declared by the said Testator to be his last Will and Testament, and each of us, at the request of said Testator and in his presence, and in the presence of each other, sign our names as witnesses thereto, at the end of the Will.

of Silas Hills, Deceased

Washington County, ss
George Liddle and Dennis J. Sullivan, being duly sworn in open Court, severally depose and say, that they were acquainted with the above named Silas Hills in his life time, and that they and each of them were present, and saw him subscribe his name at the end of the instrument in writing now introduced and exhibited to them, purporting to be the last Will and Testament of the said deceased, bearing date 17th day of January, A.D. one thousand eight hundred and eighty four. That the said deceased at the time of subscribing his name as aforesaid published and declared the said instrument to be his last Will and Testament, in the presence of these deponents and each of them, and these deponents, at the request of the said deceased, and in his presence and in the presence of each other, subscribed their names respectively thereto as witnesses to the execution thereof.

That at the time of the execution thereof, the said deceased was a citizen of the United States, above the age of twenty-one years, of sound disposing mind and memory and not under restraint, to the best of the knowledge, information and belief of these deponents.
