Last Will and Testament of Simeon Dennis

Copy of the last will and testament of Simeon Dennis deceased. 

Be it remembered that I Simeon Dennis Esqr of Easton in the County of Washington and State of New York being weak in body but of sound mind and memory and considering the uncertainty of this life do make and publish this my last will and testament in manner following In the first place I order all my just debts and funeral charges to be paid and satisfyed by my Executor hereinafter named and appointed I give and bequeath to my wife Susannah Dennis one half of my house furniture to consist of such articles as she shall chose to have and she is to have the use of them so long as she shall live and I further give to my said wife so long as she shall remain my widow the lawful Interest of one thousand Dollars to be paid to her annually by my Executor herein after named and appointed all which I give to my said wife in lieu of her right of Dower in my Estate if she please to except of the same and not other ways  The other half of my house furniture I give and bequeath the one fourth part thereof to my son Andres Dennis one fourth part to my daughter Clare Macumber and the other fourth part to the Children of my Daughter Catherine Peas deceased. The house furniture that I have herein disposed of is not to include that part of it which I had of Leonard Peas and I dispose of that as followeth that is to say the Desk I give to my grandaughter Susannah Peas and all the rest I give to her and her sisters to be equally divided among them.  I give devise and bequeath all the rest of my estate and property real and personal not herein other ways disposed of to my sons Thomas Dennis and Andres Dennis and to my daughter Clare Macumber and to the children of my daughter Catherine Peas deceased to them their heirs and assigns forever to be divided among them in the following manner one fourth part thereof to my son Andres Dennis one fourth part to my son Thomas Dennis one fourth part to my daughter Clara Macumber and my fourth part to the children of my Daughter Catherine Peas deceased. To this my last will and Testament I nominate Constitute and appoint my son Andres Dennis sole Executor and to enable him to fullfill this my said last will and Testament I do authorize and empower him my said Executor to sell grant and convey my estate either real or personal or both or any part thereof in fee simple to any person as he shall think convenient and to make sell and deliver Deeds and conveyances for the absolute sale and conveyance and disposal thereof and further I order my Executor to retain in his hands one thousand Dollars of my Estate to enable him to pay to my wife what I have herein given her and if the interest of the said one thousand Dollars in not sufficient for her comfortable sup port then he is to make up the deficiency out of the principal and the remainder whatsoever maybe left at the decease of my wife or when she shall cease to be my widow I order to be divided among my heirs in the manner herein before mentioned and it is my will and I order my Executor not to pay my legacy to any of my grandchildren before the arrive to the age of Eighteen years and then to allow them such interest as shall be reasonable. In witness whereof I have to this my last will and testament set my hand and seal the twenty fourth day of October in the year of our Lord one thousand eight hundred and twenty six.

Washington County ss: Be it remembered that on the 22 day of January in the year of our lord one thousand eight hundred and twenty seven personally appeared before me Samuel Standish Jr . Surrogate of the County of Washington aforesaid Redford Dennis one of the subscribing witnesses to the Will of Simeon Dennis late of the town of Easton in the said County, deceased who being duly affirmed declared that he did see the said Simeon Dennis deceased seal and Execute the instrument a copy whereof is hereunto annexed and ? with the ? of office of the said Surrogate which said instrument proponent to be the last will and testament of the said Simeon Dennis deceased bearing date the twenty fourth day of October in the year of our Lord one thousand Eight hundred and twenty six, but he heared him the said Simeon Dennis, publish and declare the same of and for his last Will and testament, and at the time thereof he the said Simeon Dennis was of sound disposing mind and memory to the best knowledge and belief of him the said Redford Dennis and that he together with Enoch Dennis and James Comstock the other witnesses to the said Will did severally subscribe their names thereto as witnesses in the presence of the Testator.

In testimony Whereof the said Surrogate hath  hereunto set his hand and affixed his seal of office. Done at ? this 22 day of January in the {SS \} year of our Lord one thousand Eight hundred\par and twenty seven.

Washington County ss: Be it also remembered that on the 22 day of January in the year of our Lord one thousand eight-hundred and twenty seven personally appeared before me the said Surrogate Andres Dennis Executor in the aforesaid Will named and was duly sworn to the faithful performance and execution thereof by taking the usual oath in that case provided.
