This Indenture made this seventh Day of November in the year of our Lord one thousand seven
hundred and eighty nine Between William
Frasier of the city of New York, Carpenter and Ruth his wife of the one part
and John McQueen of the County of
Washington in the State of New York yeoman
of the other part Witnesseth that the said William Frazier and Ruth his wife for
and in consideration of the sum of two
hundred and seventy two and fifteen
shillings lawful money of the said State of New York to them in hand paid said
by the said John McQueen at or
before the ensealing
and delivery here of the receipt whereof is hereby acknowledged. Hath granted
bargained, sold, aliened, released and confirmed and by these presents doth
grant bargain, sell, alien, release and confirm unto the said the said John McQueen in his actual possession
on now being by virtue of a bargain and sale to him thereof made for one whole
year by Indenture bearing date the day next before the day of the date of these
presents and by force of the Statute of a transferring uses into possession and
to his heirs and assigns forever All that certain Lot of ground in the Town
& Lot of the Township of Argyle
distinguished by the number thirty four
of the Town Lots & Bounded as follows: to wit beginning on the south side
of the Street at the Chestnut sapling marked 33 and 34 thence runs East eight Chains two Links to a
Beach sapling marked 34 and the Letter “M” Thence runs south forty three chains
seventy three Links 35 a Stake East twenty two links from a black Oak tree
marked 34 and the Letter “M” thence west eight chains two links to a stake
south East ten Links from an Ironwood tree marked 33 and 34 thence north to
where it began containing thirty five Acres strict measure and Also all that Farm
in the said Township distinguished by number 34 of the Farms bounded as follows
to wit beginning at a large white Oak Tree marked 35 and 34 thence now south
along Campbell’s Land eight chains
sixty eight links to a stake east twenty one links from a Maple Tree marked 34
and 35 Thence east one hundred and fifteen chains nine links to a White Pine
Tree marked 35 and 34 thence north twenty eight chains sixty eight links to a
White Pine Tree marked 34 and 35 thence west to where it began containing three hundred thirty two and an half Acres
of Land including the usual allowance for highways Together with all and
singular the rights and privileges advantaged rights members here determents to
the same granted from here above mentioned belonging and in anyways appertaining
and all the estate rights, rights, Title, covenant Deeder
claim and demand of them the said William
Frasier and Ruth his wife of in and
to the same and the reversion and revisions remain demand remainder rents
issues and profits of the said premises with the appurtenances To have and to
hold the said premises hereby granted with the appurtenances unto the said John McQueen his heirs and assigns to
the only proper use and behoof of him the said John McQueen his heirs and assigns forever
and the said William Frasier for
himself his heirs and assigns doth covenant and grant to and with the said John McQueen his heirs and assigns that
he the said John McQueen his heirs
and assigns shall and may from time to time and at all times hereafter
peaceably and quietly have hold occupy possess and enjoy the said premises
hereby granted with the appurtenances and here determents without the let suit
Trouble hindrance molestation Interruption or denial of him the said William Frasier his heirs and assigns
and of all and every person and persons whatsoever and freed and discharged of and from all former and other gifts,
grants, bargains, sales, lease, mortgages, deeds, uses, wills, rents and of and
from all Other charges estates rights Titles and encumbrances whatsoever and
lastly that he the said William Frasier
his heirs, and assigns and the said John
McQueen his heirs and assigns again him the said William Frasier and his heirs, and against all & every other
person and persons whatsoever shall and will warrant and forever defend by
these presents In witness where of these certify to these presents have
hereunto interchangeably set their hands & seals the day and year first
above written William Frasier (W.F.)
Ruth Frasier (R.F.) Sealed and
delivered in the presence of the words and the reversion and Eversigns being first wrote on a azure on the fifteenth
line Anthony J. Blanch and Peggy Grace. Received on the day of the
date of the within Release from the within named John McQueen the full consideration money therein mentioned William Frasier. Witnesses Anthony J. Blanch, Peggy Grace. Be it remembered that on the twenty Day of November
the year of our Lord one thousand seven hundred and eighty nine before one James M. Hughes Esquire one of the
masters of the Court of Chancery for the State of New York personally appeared William Frasier and Ruth his wife in
the within Indenture of Release named and the said William Frasier acknowledged that he sealed and delivered the said
indenture of release us and for his voluntary act and deed for the uses and
purposes therein mentions and the said Ruth
being by me & assigned privately separate and apart from her said husband
also acknowledged that she sealed and delivered the said Indenture and for her
voluntary deed for the uses and purposes thesein
mentioned without the Fear, threat, or compulsion of her said husband and I
having received the same and finding no
material erasures or Interlineations therein do allow the same to be recorded
James M. Hughes master in Chancery. I certify the aforegoing
Record to be a true copy of the Original Deed having examined and compared the
same with the Record and entry there of this 8th Day of July
