Dorastus D. Dennis
I Dorastus D. Dennis of the town of Easton in the
County of Washington and State of New York & considering the uncertainty of
this mortal life & being weak in body but of a sound mind & memory for
which favor I feel thankful. I do make & publish this my
Will & Testament in the manner and form following to wit: Item 1st. I give
& bequeath unto my beloved niece Susan D. Pease of Lockport & State
aforesaid, the daughter of Lloyd Smith late of same place deceased and wife of
B. Pease six hundred dollars to be paid her or her heirs or assigns by my
executrix therein after named for that purpose one year after my decease and to
be paid in the town of Easton or County of Washington. 2nd I give &
bequeath unto my beloved niece Jane E. Smith of the town of Easton aforesaid
daughter of David Smith late of the same place one thousand dollars to be paid
her by my said Executrix one year after my decease the same to be paid in said
town or County. 3rd. I give and devise unto my beloved wife all and singular my
real estate consisting of the house and lot with the appurtenances thereunto
belonging on which I now reside her heirs assigns forever and hereby constitute
& appoint my said wife Sarah W. Dennis my sole excutrix
of this my last Will & Testament re? ? her my
utmost confidence to perform each & every part herein requested ? To settle
and pay all my just debts funeral charges & c. the words "her heirs
& assigns forever" inter? before signed & sealed & c. 4th I
give and bequeath unto my said Wife Sarah W. Dennis all and singular the
residue of my property real & personel and the
power to convey & sell the said real Estate and give as good a title as I
could now do, if disposed to sell the same including the right to use the
spring (which I now do) for water and the right to repair at any time along the
line of pipe see reserve made in deed to David Smith by myself & wife Dorinda Dennis & c. 5th I hereby revoke all former
wills and declare the above to be my last will & testament : In witness
whereof I hereby set my hand and seal this ninteenth
day of Oct. October In the year of our Lord one thousand eight hundred seventy.
Signed sealed published declared by the above named Dorastus
D. Dennis to be his last will and testament in the presence of us who have
hereunto subscribed our names as witnesses in presence of the testator and each
other.

In the matter of Proving the Last will and testament of Dorustus
D. Dennis Decd.
Washington County. ss.
George H. Deuel and Valentine Fryer of the town of Easton in said County of
Washington being duly sworn in open Court severally depose and say, that they
were acquainted with the above named Dorustus D.
Dennis in his life time; and that they and each of them were present, and saw
him subscribe his name at the end of the instrument in writing now produced and
exhibited to them, purporting to be the last Will and Testament of the said
deceased, bearing date the ninteenth day of October
A.D. one thousand eight hundred and seventy. That the said deceased at the time
of subscribing his name as aforesaid, published and declared the said
instrument to be his last Will and testament, in the presence of these
deponents and each of them; and these deponents, at the request of the said
deceased, and in his presence and in the presence of each other, subscribed
their names respectively thereto as witness to the execution thereof, the said
deceased was a citizen of the United States, above the age of twenty-one years,
of sound disposing mind and memory and not under restraint to the best of the
knowledge, information and belief of these deponents.
